Introduction

प्रस्तावना

ऐसी स्थिति में भारत के सर्वोच्च न्यायालय ने कई बार कहा है कि “जो विवाह व्यवहारिक रूप से समाप्त हो चुका हो, उसे न्यायिक आदेश द्वारा पुनर्जीवित नहीं किया जा सकता।”
सर्वोच्च न्यायालय का दृष्टिकोण
सर्वोच्च न्यायालय ने माना है कि यदि पति-पत्नी के बीच संबंध पूरी तरह टूट चुके हैं और साथ रहने की कोई संभावना नहीं है, तो उन्हें जबरन वैवाहिक बंधन में बांधे रखना न्याय और मानवीय गरिमा के विरुद्ध होगा।
